1.SUBJECT
This contract of terms and conditions of sale, has as its object the purchase of products made at a distance by the customer (from now on “Purchaser”), through the website sanleonardello.it” owned San Leonardello Soc. Semplice Agricola di Calabretta Vera & C., with Via Madonna della Libertà 165 95014 San Leonardello di Giarre Catania – Sicily, as Seller (from now on “Seller”).
Purchases from this platform are reserved for direct user Customers, in accordance with the provisions of Legislative Decree 185/99 and the regulations of Art. 13 GDPR with regard to confidentiality.
This contract must be read, printed and kept before purchasing any product on the sanleonardello.it platform. At the time of purchase, this contract must be accepted from point 1 to point 11. It is then understood to be accepted with the confirmation of acceptance of the same, from point 1 to point 11.
2.TERMS OF ACCEPTANCE AND CONCLUSION OF THE CONTRACT
The Purchaser, following the procedures indicated, will add the product(s) to the cart, displaying the prices and shipping costs. The Purchaser may then send the purchase order to the Seller, formalising it through payment. The purchase order is considered correctly sent only if payment is completed. Having received the purchase order, the Seller will immediately send an e-mail to the Purchaser, informing him of the receipt of the order. This communication does not confirm the acceptance of the order, but only communicates its receipt.
Within 5 (five) days after the purchase order has been placed, and in any case as soon as possible, the Seller shall send a second e-mail informing the Purchaser of the acceptance of the order, specifying its status, which may be “in process”, “completed”, “suspended”, “awaiting payment”.
The Seller may declare the order “suspended” if there are no products available. In the latter case, the Seller will be responsible for proposing a product exchange or refund of the corresponding amount.
The Seller may not accept the purchase order in the following cases:
– If the payment is not confirmed by the credit card issuer;
– If the payment made by the Buyer cannot be verified due to the absence of a receipt documenting the transaction;
– If the Seller declares that the purchased product (or products or part of the products) is not available at the time of purchase, even if it (or these) are available on the “sanleonardello.it” website.
In the event that the order cannot be accepted, it will be the Seller’s concern to inform the Purchaser and propose the choice of a different product, a refund or other. By confirming the purchase order, the Buyer declares that he has accepted the present contract of terms and conditions in all its points. The present contract can be considered “concluded” only if, via the “sanleonardello.it” website, the Purchaser correctly concludes the purchase order finalised with payment, and the latter is correctly accepted by the Vendor.
3.CUSTOMER COMMITMENTS
These General Terms and Conditions of Sale are always available online, and must be read carefully and accepted by Customers before sending their orders. The placing of an order therefore implies their total knowledge and acceptance.
The Customer undertakes and is obliged, once the online purchase procedure has been completed, to print and keep these General Terms and Conditions of Sale, which have already been read and accepted during the purchase process carried out, in order to fully satisfy the condition set out in Articles 3 and 4 of Legislative Decree no. 185/1999.
4.PRICES
All prices on the website include VAT. Shipping costs are not included in the price of the products, but are specified when the products are added to the shopping cart.
5.PAYMENTS
The Purchaser will undertake to pay for the purchased products and the relative shipping costs, when placing the order through the use of the payment services offered by the Seller. The company from the Purchaser when entering payment data San Leonardello Soc. Semplice Agricola di Calabretta Vera & C. is not responsible for any error made or other data entered incorrectly, and also is not responsible if the Purchaser will be the victim of online fraud or unlawful acts committed by third parties outside the site sanleonardello.it.
6.SHIPMENTS AND DELIVERIES
The “sanleonardello.it” website shall only accept purchase orders with shipment within Italian territory. The Vendor, having accepted the purchase order from the Purchaser, will provide within 5 (five) working days, to entrust the Courier with the shipping service in order to make delivery to the Vendor. Shipping service” means entrusting the Courier with the material purchased by the Purchaser, in order to deliver it to the latter at the address indicated in the purchase order.
Delivery times, as declared by the Courier, are generally 4-5 (four-five) working days from the date of shipment, for most of the national territory. In rare cases, delivery may be delayed by 1 (one) additional working day. The Seller is not responsible for delays in delivery if these are caused by incorrectly detailed address entries, unspecified delivery instructions, delays by the General Courier and due to the recipient not being available, force majeure events and/or uncontrollable and unforeseeable events, such as strikes, adverse weather/climate conditions, floods, storms, earthquakes, and similar events.
The Purchaser, during the purchase phase, must correctly enter the data relating to the shipping address and a mobile telephone number useful for any communication from San Leonardello Soc. Semplice Agricola di Calabretta Vera & C and to be provided to the Courier, in charge of the shipping service. The Purchaser will be aware and accept that the shipping address and mobile phone number provided will be communicated to the courier and included in the waybill attached to the shipment, in order to facilitate delivery operations. Having accepted the purchase, the Seller will send the Purchaser an e-mail confirming that the shipment has been made.
In the event that the Purchaser does not receive the goods by the established deadline, the Seller invites the Purchaser to receive information from the Courier, which is better specified in the shipment confirmation phase, for any information on delivery and/or any other information, as the delay may be caused by the impossibility of finding the consignee, and therefore the Courier can provide useful information in this regard.
In the event that there should be further problems relating to non-delivery, the Company San Leonardello Soc. Semplice Agricola di Calabretta Vera & C is always at the total service of the Buyer, providing assistance by telephone or e-mail contact listed on this contract and on the website “sanleonardello.it”, in order to reach an agreement that may provide, at the discretion of the Company San Leonardello Soc. Semplice Agricola di Calabretta Vera & C, a new shipment of the product or a full refund to the Buyer.
7.RIGHT OF WITHDRAWAL
The Purchaser has the right to withdraw from the contract, even without specifying any reason, within 14 (fourteen) days from the date of delivery of the goods, or from the date on which the Courier certifies that they have been delivered to the recipient. To exercise this right, the Purchaser must send a communication by e-mail to info@sanleonardello.it, specifying unequivocally that he intends to withdraw from this contract, returning the products and requesting a refund. The Company San Leonardello Soc. Semplice Agricola di Calabretta Vera & C received the above communication, will quickly communicate to the Purchaser all the useful and necessary instructions for a correct procedure for the return of the goods and refund.
The Buyer is hereby aware and will be further informed that the Company San Leonardello Soc. Semplice Agricola di Calabretta Vera & C may not consider valid the withdrawal, if the returned product is damaged, tampered with, modified, without original packaging, without original labels, if it has even minor signs that have altered the aesthetic qualities. The Seller may consider the withdrawal invalid, even in the presence of only one of the defects mentioned above.
The Vendor, having received and examined the returned product, will notify the Purchaser of its receipt and acceptance of the right of withdrawal, enclosing the relative refund using the same method as that used for payment. The Company San Leonardello Soc. Semplice Agricola di Calabretta Vera & C will not require any amount for the cost of returning the product, so the Purchaser may exercise the right of withdrawal for free.
8.COMPLAINTS
Any complaints must be addressed directly to the Seller, after contacting customer service or by e-mail to info@sanleonardello.it, indicated on the site. The Seller undertakes to respond to complaints within 3 (three) working days, and to resolve any problems in the interests of the Buyer.
9.APPLICABLE LAW AND COMPETENT COURT
The contract of sale between the Purchaser and the Company San Leonardello Soc. Semplice Agricola di Calabretta Vera & C, is concluded in Italy and governed by Italian law. For any dispute relating to the validity, interpretation or execution of the same contract, the territorial jurisdiction is of the judge of the place of residence or domicile of the consumer, if located in the territory of the Italian State.
10.PROMOTIONS
The Company San Leonardello Soc. Semplice Agricola di Calabretta Vera & C may offer discounts and/or advantages to users, through paper or digital coupons, the latter transmitted by e-mail, usable only through the website “sanleonardello.it” and regulated by the Seller itself.
